1. Who we are

The Services are provided by Nougex India (“Nougex”, “we”, “us”, or “our”). Contact: hello@nougex.in.

2. Eligibility

You must be able to form a binding contract under applicable law to use our Services. Our apps are intended for adults. If you allow a minor to use a device with our apps installed, you are responsible for their use and for ensuring it complies with these Terms and applicable law.

3. License to use our apps

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use our apps for your personal, non-commercial purposes on devices you own or control, as permitted by the applicable app store’s rules.

You may not:

• Copy, modify, or distribute our apps or website content except as allowed by law
• Reverse engineer or attempt to extract source code, except where prohibited by law
• Use the Services for unlawful, harmful, or abusive purposes
• Interfere with or disrupt the Services or their security
• Remove copyright, trademark, or other proprietary notices

4. Your content

You may enter or upload content in our apps (for example, study documents, baby care logs, or names you type). You retain ownership of your content. You are responsible for your content and for having the rights to use it.

You grant us a limited license to process your content only as needed to operate the features you use (for example, storing logs locally on your device or generating quizzes from a document you selected).

5. Not medical or professional advice

Nougex apps — including NanheKadam — are tools for organization and information. They do not provide medical, nutritional, legal, or other professional advice. Tips, recipes, and reminders are for general informational purposes only. Always consult qualified professionals for health or care decisions.

6. App stores

If you obtained an app through Google Play, the Apple App Store, or another marketplace, that store’s terms also apply. The store provider is not responsible for the app’s content, maintenance, or support — Nougex is.

7. Privacy

Our collection and use of information is described in our Privacy Policy and any app-specific privacy policies (such as the NanheKadam Privacy Policy).

8. Updates and changes

We may update the Services, change features, or discontinue apps or features at any time. We may also update these Terms. Continued use after changes means you accept the updated Terms. Check this page for the latest version.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOUGEX INDIA AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) INR 1,000, TO THE EXTENT PERMITTED BY LAW.

11. Indemnity

You agree to indemnify and hold Nougex harmless from claims arising out of your misuse of the Services, your content, or your violation of these Terms or applicable law.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in India shall have exclusive jurisdiction, unless applicable consumer protection law requires otherwise.
